Federal Act on Data Protection (FADP) – Switzerland
The FADP of Switzerland, which was updated in 2023, made the protection of personal data even more potent and at the same time ensured that there would be no conflict with the EU’s GDPR. The revision was applicable to all the public and private institutions which were dealing with the personal data of persons residing in Switzerland.
What is FADP Compliance?
For the society as a whole, FADP implies that the organizations have to be open and honest about their personal data processing practices and they have no right to do so with the sensitive data unless they have received approval or have a legal basis. It brings in privacy impact assessments, data breach notifications, and stronger rights for individuals.
The Federal Data Protection and Information Commissioner (FDPIC) is the one who checks the compliance and, by doing so, makes sure that Switzerland continues to be a reliable place for secure data transfer and international cooperation under the “adequacy” status granted by the EU.
